Acceptance-This agreement is accepted in full upon signature. National Construction News Inc (NCN) re-serves the right to terminate this agreement for any reason within 30 days of the effective date.
General-The written terms and provisions of this agreement contain the entire agreement between parties. This agreement may be amended unilaterally by NCN by giving written notice to subscriber. The amendments shall be binding unless subscriber terminates the agreement within 30 days if receipt of the amendments. This agreement shall not be assignable by either party, in whole or in part, without the prior written consent of both parties. Acts of God-NCN shall not be liable for problems encountered due to strikes, fire accidents, acts of war, acts of Government. Acts of God or any other cause beyond the control of NCN. Breach of Contract-NCN shall have the right to terminate this contract and discontinue service in the event of any breach of terms and conditions of this agreement. Termination notice will be given immediately. NCN shall retain all rights and remedies available at law or in equity. Use of Product and Ownership-All information contained herein is owned exclusively by NCN and is for the use of paid subscribers. This material is copyrighted and may not be sold, duplicated or otherwise transmitted to any party. Subscriber hereby agrees to protect the copyright and other proprietary rights of NCN in the information both during and after the terms of this contract, and shall honor and comply with the reasonable written requests to protect said rights. Limitation of Liability-NCN makes no guarantees as to the accuracy or completeness of the information and shall not be liable for errors, omissions, or inaccuracies. NCN makes no warranties, either express or implied, as the suitability of the material for a particular purpose or use. The information obtained by NCN is believed to be reliable, but the accuracy and completeness are not guaranteed. NCN shall not be held liable for loss of profits or for punitive or consequential damages with regard to errors, omissions or inaccuracies. The subscriber agrees that the limit of NCN's liability shall be the replacement of product, corrected information or prorated amount of the subscription. It is further agreed that the opinion of the listed remedies shall be the decision of NCN. |
